Heads of Mexican consular offices hold notarial powers under Article 44, section IV of the Mexican Foreign Service Act, with public faith equivalent to that of a notary in Mexico City. A power of attorney granted at a consulate therefore takes effect in Mexico with no apostille and no protocolisation, which is what makes it the practical route for anyone handling property, inheritance or court matters back home.

A document signed before a U.S. notary public is a different animal. It is not valid in Mexico as it stands: it needs an apostille, a certified translation and protocolisation before a Mexican notary, which adds cost and several points of failure.

Work out how many testimonios you will need before signing. If the power will be used before a court, a registry and a bank, each one will want its own copy, and ordering more later means starting a fresh procedure from abroad.

How to apply

  1. Decide exactly what powers you are granting: litigation and collections, acts of administration, acts of ownership, or a limited power for one specific transaction.
  2. Collect the full legal names of the grantor and the attorney-in-fact, spelled exactly as they appear on their official Mexican documents.
  3. Book an appointment at citas.sre.gob.mx or through the consular WhatsApp line. Every person signing needs their own appointment folio, even when they sign the same instrument.
  4. Submit the application and supporting documents for review by the consular legal section.
  5. Pay the fee and return to sign before the consular officer.
  6. Collect the testimonio and send it to your attorney-in-fact in Mexico.

What consulates cannot do

Consular notarial powers cover acts that will be performed in Mexican territory. Consulates do not certify ordinary contracts between private parties and do not issue documents for use inside the United States.

Companies

When the grantor is a company, the consulate asks for the incorporation documents and the board minutes appointing the signatory. Corporate documents issued in the United States must be apostilled by the Secretary of State and translated into Spanish.

Revoking a power

A power of attorney is revoked by a further instrument, granted the same way, and the revocation has to reach whoever is holding the original power. Leaving an old general power in force is a common and expensive mistake.

Appointment availability

Notarial slots are the scarcest service at most Mexican consulates. When the wait is measured in months, the U.S. notary route with apostille and protocolisation may be faster, even though it costs more and carries more risk of rejection in Mexico.
