Ghana is a common-law jurisdiction, so a power of attorney follows the English pattern: it is drafted by a lawyer in Ghana, executed here before the appropriate officer, authenticated, and then acted on there. Land transactions are the dominant reason and the most exacting.
Quick facts
Land in Ghana is a complicated subject: much of it is held under customary or stool tenure, titles are frequently contested, and a power drawn loosely can cause real loss. The lawyer there should confirm the position before anything is signed.
Fees breakdown
| Item | Cost | Notes |
|---|---|---|
| U.S. notarisation | $5–$25 per signature | Bring it unsigned |
| State certification | $3–$25 per document | Secretary of State |
| Consular authentication | Consular tariff | Where required |
| Stamping and registration in Ghana | Charged there | Lands Commission |
| Lawyer’s fees in Ghana | Agreed with the firm | Drafting and completion |
Registration at the lands authority is what makes a transaction effective against third parties, and it is a separate cost and timetable from anything done here.
How to apply
- Instruct a lawyer in Ghana to draft the power for the specific transaction.
- Ask whether consular authentication is needed or a certification suffices.
- Bring the document unsigned and sign before the officer named in the instructions.
- Obtain the certifications in the order the lawyer specifies.
- Courier the original to Ghana and keep the tracking record.
- Have it stamped and registered before anyone acts on it.
Required documents
- Valid photo identification for every signatory.
- The unsigned draft, complete and unaltered.
- Full details of the person receiving the power.
- Land documents, site plans or case references.
- Witnesses where the draft requires them.
- Payment for each stage.
Where to apply
Notarisation locally, certification by the state, and authentication at the mission covering your state where it is required.
Additional notes
Land is the risk
Buying or selling land in Ghana from abroad is where most diaspora money is lost. Verify the title through a lawyer before granting any authority.
Family and stool land
Land held by families or traditional authorities cannot always be dealt with by one person, however clear the power looks.
Be specific
Name the plot, the site plan reference and the acts authorised. Broad wording is both refused and dangerous.
Revocation
Revoking requires a further document through the same route, with notice to the lands authority and to whoever holds the original.
