Haiti changed its position on dual nationality with the constitutional amendment of the early 2010s. Before that, acquiring another nationality cost a Haitian their own. Since then, dual nationality is recognised, although certain public offices remain restricted to those who hold only Haitian nationality.
Quick facts
In consular practice the question is rarely theoretical. What posts ask for is proof of Haitian origin: either a birth certificate or a previous Haitian passport, presented alongside a valid foreign passport.
How it works in practice
| Situation | Position | What to bring |
|---|---|---|
| Haitian who naturalised abroad after the amendment | Keeps Haitian nationality | Foreign passport plus proof of origin |
| Child born in the U.S. to a Haitian parent | Haitian by descent | U.S. birth certificate and the parent’s documents |
| Person who lost nationality under the old rule | Position depends on the facts | Take advice before filing |
| Candidate for certain public offices | Restrictions apply | Specialist advice needed |
Because the rules changed within living memory, families often contain people in different positions depending on when they naturalised.
How to establish your documents
- Locate a birth certificate from the archives, or a previous Haitian passport.
- Gather the parents’ documents where the claim is by descent.
- Ask the consulate covering your area which evidence it accepts for your case.
- Apply for a Haitian passport, or for a certificate of identity where one is appropriate.
- Have any U.S. documents legalised through the chain, not apostilled.
- Keep the set together for later procedures.
Required documents
- Valid foreign passport, where you hold one.
- Haitian birth certificate or previous Haitian passport as proof of origin.
- Parents’ documents for claims by descent.
- U.S. civil documents, legalised where they form part of the file.
- Identification and proof of address.
- Payment in the accepted form.
Where to apply
At the consulate covering your area, which also handles the legalisation of any U.S. documents in the file.

Proof of origin is the recurring requirement
Almost every consular service for the diaspora comes back to it, which is why obtaining a birth certificate from the archives is worth doing before anything else.
Public office restrictions
Recognition of dual nationality did not remove every restriction. Anyone considering candidacy for office in Haiti should take specific advice.
Children born here
A child of a Haitian parent has a claim by descent, but the documents establishing the parent’s own status are what the consulate will examine.
Take advice on old losses
Where nationality was lost under the previous rule, the position depends on dates and facts that only a specialist can assess properly.
