Nationality rules differ enormously between countries, and this is not a page that can tell you whether you qualify. Some countries pass citizenship down indefinitely; others stop at one generation born abroad, require registration before a deadline, or do not permit dual nationality at all. What follows is how to find out for Slovakia, and what to settle before you spend anything.

Ask the consular office what Slovak law actually allows in your circumstances before engaging anyone to help with it. Genealogists and specialist firms exist and can be useful where records are old or scattered, but they are not a substitute for knowing whether the claim exists at all โ€” and that answer is free.

Slovakia: the five-year residence test decides it

Under ยง 9 of Act No. 40/1993 on citizenship, a Slovak citizen loses Slovak citizenship on the day they voluntarily acquire a foreign citizenship. There is no proceeding and no decision: the authority merely records what has already happened.

The exception, added in 2022, is a residence test. Loss does not occur if the citizen had, at the time of acquiring the foreign citizenship, at least five years of permitted, registered or otherwise recorded residence in that State โ€” and the condition counts as met only if the person was actually present there during that time. So:

Nothing is applied for beforehand. This is the part most often got wrong: there is no permission and no retention permit. The exception works by law if the facts are there. What there is, is an obligation afterwards: written notification within 90 days to the district office at the regional seat, with paper documents proving both the acquisition and the length of residence. If the office finds the condition unmet, it notifies the loss and records it.

For those caught by the harsher rule, the way back is a right, not a favour. Between 17 July 2010 and 31 March 2022 the law stripped citizenship with no exception at all. ยง 7(7) now says Slovak citizenship shall be granted to anyone who lost it in that window and meets the same five-year residence test, waiving the normal requirement of residence in Slovakia. It is granted by the Ministry of Interior, and the application can be filed in person at a Slovak consulate in the United States.
