Ask the consular office what Gambian law actually allows in your circumstances before engaging anyone to help with it. Genealogists and specialist firms exist and can be useful where records are old or scattered, but they are not a substitute for knowing whether the claim exists at all โ€” and that answer is free.

Gambian citizenship and the U.S. oath

Section 12A(1) of the Constitution, inserted in 2001, states that a citizen of The Gambia who acquires the citizenship of another country may, if he or she so desires, retain citizenship of The Gambia. Nothing has to be filed and no procedure is prescribed: retention operates by the section itself.

Section 13(4) goes further for citizens by birth or descent. Nothing in the Constitution or any other law may be construed as depriving, or authorising anyone to deprive, a Gambian by birth or descent of citizenship โ€” whether on account of holding the citizenship of another country or for any other cause. That is an absolute bar.

Deprivation exists only for citizens by registration or naturalisation, and even then it is never automatic: the Secretary of State must apply to the High Court, after written notice of the grounds and of the right to be heard and legally represented, and the court makes the order only if satisfied.
